Terms of Service

Whimsy provides tools that let you find and complete side quests, alone or with a group, connect with friends, and share your completed quests, photos, and notes with the community.

You may use the Service only in compliance with these Terms and all applicable laws. You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes
• Post content that is illegal, harassing, hateful, sexually explicit, or harmful to other users
• Attempt to interfere with or disrupt the Service or its security
• Reverse engineer, copy, or misuse the Service beyond its intended functionality
• Use the Service to infringe on the rights of others
• Impersonate another person or misrepresent your affiliation

We reserve the right to suspend or terminate access and to remove content if these Terms are violated.

To access the Service, you may be required to create an account or sign in using a third-party authentication provider (such as Google).

You are responsible for maintaining the confidentiality of your account credentials and all activity that occurs under your account.

You retain ownership of the content you create or share through the Service, including completed side quests, photos, and notes.

By posting content to a group or the community tab, you grant Whimsy a limited, non-exclusive right to store, process, and display that content to other users as part of normal app functionality, and to use it solely to operate, support, and maintain the Service.

You are solely responsible for the content you share. We do not claim ownership over your content, and we do not use your content to train or fine-tune any AI models.

Whimsy allows you to create or join groups and invite friends to participate in side quests.

• If you join a group, other members may see your activity, participation, and content you share within the group.
• If you invite a friend, we will use the contact information you provide solely to deliver the invitation.
• You are responsible for the groups you create or join and the people you invite.

The community tab allows users to view side quests, photos, and notes shared publicly by other users. Content you share to the community tab may be viewed by any user of the Service. You control whether and what you share publicly.

The Service may rely on or integrate with third-party services, including authentication and hosting providers. Whimsy is not responsible for the availability, accuracy, or performance of third-party services.

We may modify, update, or discontinue any part of the Service at any time. We do not guarantee that the Service will be uninterrupted or error-free.

You may stop using the Service at any time. Data deletion is handled as described in our Privacy Policy.

We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the security of the Service or other users.

The Service is provided on an "as is" and "as available" basis. Side quests are provided for entertainment and personal-productivity purposes only. Whimsy does not guarantee the safety, accuracy, or suitability of any quest, and you complete quests at your own risk.

To the fullest extent permitted by law, Whimsy disclaims all warranties, express or implied.

To the fullest extent permitted by law, Whimsy will not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Service.

Whimsy's total liability for any claims related to the Service will not exceed the amount you paid to use the Service, if any, in the preceding 12 months.

You agree to indemnify and hold harmless Whimsy from any claims, damages, losses, or expenses arising from your use of the Service, content you share, your violation of these Terms, or your violation of any applicable laws or third-party rights.

These Terms are governed by and construed in accordance with the laws of New York, United States, without regard to conflict of law principles.

We may update these Terms from time to time. Changes will be effective when posted. Continued use of the Service after changes constitutes acceptance of the updated Terms.
